Considering MCA Restructuring

Restructuring aims to change how — and how fast — an obligation is paid, rather than reducing the total. It may suit businesses that can pay, but not at the current pace.

Restructuring vs. settlement

Settlement typically seeks to reduce the amount owed. Restructuring typically seeks to modify the payment amount, frequency, or timeline — for example, changing daily debits to weekly or extending the period. Some arrangements combine elements of both.

What to consider

  • Does the new schedule fit your realistic cash flow?
  • Are there fees or increases in the total amount owed?
  • Does the modification address every position, or just one?
  • Is the change documented in a signed written amendment?
